Management of contractor's claim in Turnkey projects according to FIDIC under termination and dissolution of contract

Abstract

Generally, increasing complexity of the structural stages of the contracts and contracting conditions as well as inconvenient conditions of projects including Meteorological, political, and leads to intensification of disputes, claims and litigation between the parties to the contract and the resulting effects of them in terms of time and money in the project. And this issue which is exacerbated by international agreements may lead to the termination of the contract. On the other hand, the termination of the contract will increase the incentive for contractors to deal with existing claims. In such a situation, it is obvious that the existence of a management system in accordance with international standards has a significant role in identifying the existing claims, which will result in avoiding claims and facilitating the handling of claims and disputes between the two sides. Therefore, Management of contractor's claim in EPC/Turnkey projects according to FIDIC under termination and dissolution of contract has been studied in this study. For this purpose, with its reliance on PMBOK, it has been tried to collect interviews and questionnaires among experts in civil engineering projects and rely on experts' opinion, as well as using system dynamics modeling, the claims to be more accurately and practically analyzed in these conditions so that the contractor can keep his rights in terms of termination and suspension, and is more prepared to receive his lost salary.
