Legal review of BOT and EPC contracts in road construction projects

Abstract

BOT and EPC contracts are of great importance to law and economics professionals. Different countries, especially developing countries, regard these contracts as an effective tool for attracting foreign capital and using private sector management in infrastructure projects. For the success of the state, it must provide a suitable economic, political, and, in particular, legal environment for a private investor. The only legal text in the Iranian legal system that deals with this agreement is the Foreign Investment Promotion and Enforcement Act, which, of course, covers many aspects of BIS. T is silent. Some of Iran's internal regulations regarding this agreement are contrary to the WTO rules and need to be amended. Therefore, this article reviews the legal status of the two contracts. The results show that due to the variety of projects that can be implemented in this way and the specific features of each one, it is necessary for different institutions and ministries to Compliance with this law is to prepare its executive code according to the characteristics of projects in their respective sections.
